These Terms of Service ("Terms") govern your use of the MyPlopPlop platform, operated by 48HoursReady ("Company," "we," "our," or "us"). By accessing or using MyPlopPlop, including our website (myplopplop.com), mobile application, and all related services (the "Platform"), you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Platform, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding agreements
  • You will comply with all applicable laws and regulations in Haiti
  • You have read and understood our Privacy Policy

If you do not agree to these Terms, you must not use the Platform.

2. Platform Description

MyPlopPlop is a multi-service platform operating in Haiti that provides:

  • Marketplace: An online marketplace connecting customers with local merchants (restaurants, supermarkets, pharmacies, hardware stores, and more)
  • Delivery Services: On-demand delivery of goods from merchants to customers
  • Ride Services: Transportation services connecting riders with drivers
  • Sol (Rotating Savings): Digital rotating savings and credit groups (ROSCA/Sol) for community-based savings
  • Diaspora Services: Enabling the Haitian diaspora to send goods and services to family and friends in Haiti
  • Digital Wallet: A wallet system for managing funds within the Platform

MyPlopPlop acts as an intermediary platform. We facilitate transactions between users but are not a party to the underlying transactions between customers, merchants, and riders.

3. User Accounts

Registration

To use the Platform, you must create an account by providing your name, phone number, and a 4-digit PIN. You are responsible for:

  • Providing accurate and complete registration information
  • Keeping your PIN confidential and secure
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorized access to your account

Account Types

  • Customer: Browse stores, place orders, request rides, and join Sol groups
  • Merchant: List products, manage a store, fulfill orders
  • Rider: Accept and deliver orders, provide ride services
  • Admin: Platform administration (internal use only)

One account may hold multiple roles. Becoming a merchant or rider requires additional verification.

4. Wallet and Payments

  • All transactions on the Platform are conducted through the MyPlopPlop wallet system, denominated in Haitian Gourdes (HTG)
  • Funds can be added to your wallet via MonCash or other supported payment methods
  • Wallet balances are non-transferable between users except through Platform features (orders, Sol contributions, ride payments)
  • We reserve the right to hold, freeze, or reverse transactions in cases of suspected fraud or policy violations
  • Wallet balances do not earn interest
  • Withdrawal of wallet funds is subject to applicable fees and processing times

5. Marketplace Terms

For Customers

  • Product listings, descriptions, prices, and availability are provided by merchants and may change without notice
  • Orders are subject to merchant confirmation and product availability
  • Delivery times are estimates and not guaranteed
  • Once an order is confirmed by the merchant, cancellation may not be possible

Order Disputes

If you receive an incorrect, damaged, or missing item, you may report the issue through the Platform within 24 hours of delivery. We will investigate and may issue a full or partial refund at our discretion.

6. Ride Services

  • Ride fares are calculated based on distance, time, and current demand
  • Riders are independent service providers, not employees of MyPlopPlop
  • We do not guarantee the availability of rides at any given time or location
  • Both passengers and riders must behave respectfully and comply with all traffic laws
  • MyPlopPlop is not responsible for the conduct of riders or passengers
  • Cancellation fees may apply if you cancel a ride after a rider has been assigned

7. Sol (Rotating Savings Groups)

Sol is a digital version of the traditional Haitian rotating savings group (ROSCA). By participating in a Sol group, you agree to the following:

  • Commitment: When you join a Sol group, you commit to making all required contributions for the full cycle duration
  • Contributions: You must make your contribution on time for each cycle. Late or missed payments may result in removal from the group and account penalties
  • Payouts: Payouts follow the order determined by the group administrator (which may be randomized). You will receive your payout when it is your turn in the rotation
  • Fees: A platform fee of 2% is applied to each contribution. A withdrawal fee of 1.5% applies when transferring Sol payouts to external payment methods. An access fee of 150 HTG applies to join groups
  • Group Size: Sol groups have a minimum of 3 and maximum of 30 members
  • Risk: While we facilitate Sol groups digitally, participation involves inherent financial risk. MyPlopPlop is not a bank and does not guarantee the performance of Sol group members
  • Removal: Group administrators may remove members who fail to meet their contribution obligations

8. Referral Program

  • Users can earn commissions by referring new users to the Platform using their unique referral code
  • 48HoursReady Packages: Referrers earn 10% commission on all package purchases made by referred users
  • MyPlopPlop Platform: Referrers earn 10% of the platform fees generated by referred users, for the first 3 months after the referred user joins, subject to a maximum payout cap per referred account
  • Referral commissions are credited to your wallet
  • Self-referrals, fake accounts, or any form of referral abuse will result in forfeiture of commissions and possible account termination
  • We reserve the right to modify the referral program terms at any time

9. User Conduct

You agree NOT to:

  • Use the Platform for any illegal purpose
  • Create multiple accounts or use fake identities
  • Harass, threaten, or abuse other users, merchants, or riders
  • Manipulate ratings, reviews, or referral systems
  • Use the Platform to launder money or conduct fraudulent transactions
  • Attempt to access other users' accounts or personal information
  • Interfere with the Platform's operation or security
  • Use automated bots or scripts to interact with the Platform
  • List counterfeit, stolen, or prohibited goods on the marketplace

Violation of these rules may result in immediate account suspension or termination.

10. Merchant Terms

By registering as a merchant on MyPlopPlop, you agree to:

  • Provide accurate product descriptions, prices, and availability
  • Fulfill confirmed orders in a timely manner
  • Maintain food safety and hygiene standards (for food merchants)
  • Accept the platform commission on each sale (default 15%, may vary by category)
  • Handle customer complaints and product issues professionally
  • Comply with all applicable Haitian business regulations and licensing requirements

11. Rider Terms

By registering as a rider on MyPlopPlop, you agree to:

  • Maintain a valid driver's license and proper vehicle documentation
  • Keep your vehicle in safe, roadworthy condition
  • Handle all deliveries and passengers with care and professionalism
  • Follow the most efficient routes and deliver within reasonable timeframes
  • Not consume alcohol or drugs while providing services through the Platform
  • You are an independent contractor, not an employee of MyPlopPlop

12. Fees and Commissions

  • Marketplace Commission: MyPlopPlop charges merchants a commission on each sale (default 15%)
  • Ride Commission: A platform fee is applied to each ride fare
  • Sol Fees: 2% cycle fee on contributions, 1.5% withdrawal fee, 150 HTG access fee
  • Payment Processing: Fees may apply for adding or withdrawing funds depending on the payment method

All fees are displayed transparently before you confirm any transaction. We reserve the right to modify fee structures with reasonable notice.

13. Limitation of Liability

To the fullest extent permitted by law:

  • MyPlopPlop is provided "as is" without warranties of any kind, whether express or implied
  • We are not liable for the quality, safety, or legality of goods sold by merchants
  • We are not liable for the actions or conduct of riders, merchants, or other users
  • We are not liable for losses resulting from Sol group member defaults
  • We are not liable for service interruptions, data loss, or technical issues beyond our reasonable control
  • Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim

14. Dispute Resolution

In the event of a dispute:

  1. Internal Resolution: First, contact us through the Help Center. We will attempt to resolve the issue within 7 business days
  2. Mediation: If the dispute cannot be resolved internally, both parties agree to attempt mediation before pursuing other remedies
  3. Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Haiti
  4. Jurisdiction: Any legal proceedings shall be brought before the competent courts of Port-au-Prince, Haiti

15. Account Termination

  • You may deactivate your account at any time through your profile settings or by contacting support
  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a risk to other users
  • Upon termination, any remaining wallet balance (minus applicable fees) will be returned to you within 30 days through your preferred payment method
  • Sol group obligations may survive account termination until the current cycle is complete

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Platform or via notification. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

If you disagree with the modified Terms, you must stop using the Platform and deactivate your account.
